WWE Files Suit Over Concussion Lawsuits, More Legends Planning to Sue WWE?, Lawyers Comment

– The Associated Press reports that WWE has asked a federal judge to block lawsuits by former wrestlers claiming that they have suffered long-term health problems stemming from concussions they received while wrestling for WWE.

WWE attorneys filed a lawsuit in US District Court in Connecticut on Monday and argued that the wrestler claims are fraudulent and should be barred from the court due to a three-year statute of limitations on such claims in the state of Connecticut. WWE is also asking that the various concussions lawsuits they’re facing across the country be moved to federal court in Connecticut.

Longtime WWE attorney Jerry McDevitt said the company is being targeted by lawyer Konstantine Kyros, alleging that Kyros is improperly shopping lawsuits to former WWE wrestlers around the country. McDevitt says wrestlers are being convinced they can get paid similar to how former NFL players were paid. McDevitt commented:

“Before this guy started trolling around looking for people to sue, we didn’t have one person, none, claiming they had any kind of traumatic brain injuries, or dementia or ALS or any of the kind of stuff you seek associated with the NFL.”

Kyros denied McDevitt’s allegations and said he has been retained by dozens of former WWE stars who have health problems related to their work with WWE. Kyros said he will argue that the statute of limitations does not apply when medical conditions develop years after the events that caused them. Kyros commented on the suit WWE filed on Monday in Connecticut:

“What the WWE lawsuit is doing is trying to do is prevent some of the most storied performers in the history of the organization from having their day in court.”

The AP also revealed that WWE Hall of Famers Blackjack Mulligan (Robert Windham) and Koko B. Ware (James Ware), as well as The Dynamite Kid (Tom Billington) were named in WWE’s lawsuit as all three have sent letters to WWE indicating that they intend to sue.

Mulligan spoke to the AP from his home on Wednesday and said he’s been diagnosed with dementia, has blood clots in his brain and feels abandoned by WWE. Mulligan also said his son Barry Windham has developed serious problems, including drug addiction, which he believes were related to numerous injuries. Mulligan said:

“Sargent Slaughter once went nuts on me and beat me unconscious with a turnbuckle. My jaw was broken. I lost teeth. I blacked out… They really don’t want to face it. They want to send everyone to rehab. But rehab doesn’t work for loss of memory. And my son, you look at him and the lights are on, but nobody is home anymore.”
